The 2016 REAL Australia Landscape Photography Awards

KEN DUNCAN GROUP PTY LIMITED (“Promoter”) aims to promote photography and excellence in photo-based work, including all types of analogue and digital photography. Photographers are invited to submit images for The REAL Australia Landscape Photography Awards (“Competition”).

Each entrant to the Competition (“You”) is asked to submit images which capture the quintessential Australian landscape, through images that have been subjected to minimal or no post-processing, and that are an honest interpretation of the scene.

Entries for The 2016 REAL Australia Landscape Photography Awards (“Current Competition”) opens on 22 March 2016 and closes at midnight AEST on 30 June 2016 (“Competition Period”).

The winning entries will be the three images which receive the highest average scores during the Final Judging and major prizes will be awarded as follows:

TERMS & CONDITIONS:
( 1) Information on how to enter and details of prizes form part of these Terms and Conditions.
(2) Participation in the Competition is deemed acceptance of these Terms & Conditions.
(3) Except for the Judges of this Competition, anyone may enter the Competition.
(4) All photographs submitted must be taken in Australia.
(5) The Competition will close at midnight AEST on 30 June 2016.
(6) Entry form/s and the applicable entry fee/s must be submitted at time of uploading image(s).
(7) Entry fees are as follows:
(7 a) $25 for one (1) image;
(7 b) $60 for three (3) images submitted at the same time;
(7 c) $90 for five (5) images submitted at the same time.
(8) Multiple entries are encouraged, subject to the following:
( 8 a) each entry must be substantially unique;
( 8 b each entry must be submitted in accordance with entry requirements.
(9) To enter, You must, during the Competition Period, upload your image(s) via the Competition website www.realphotoawards.com (“Website”), following the on-screen instructions carefully.
(10) The images presented for judging must be photographic in origin (taken with a camera) and must be the original work of the Entrant.
(11) Entries can be submitted as either colour or black and white images and file quality must be sufficient to allow the image to be printed for display at a minimum of 80cm on the longest length.
(12) The images submitted for judging must NOT have been submitted to the Competition in a prior year.
(13) This is a competition based on skill. Chance plays no part in determining the winners. Each entry will be judged based on the following criteria:
(13 a) Technical competency of the image;
(13 b) Photographic quality of the image;
(13 c) Photo taken within Australia;
(13 d) Adherence to the Competition theme: “Capturing the quintessential Australian landscape”;
(13 e) Minimal use of post-processing – finalists and winners must be able to provide original film or an original digital file to prove there has not been excessive image manipulation;
(13 f) Artistic merit of the image;
(13 g) Merit of the image for reproduction as a commercially viable, fine art print;
(13 h) Credibility of the image – the judges must deem it to be “believable”.
(13 i) Image/s may include people or props, but they must be in the original photo and not introduced during post-production;
(13 j) Raw conversion and/or post-production applications may be utilised, but all data in the final entry must be contained in the original digital file;
(13 k) Entries can be captured on film or as digital files, but must be submitted as digital files.
(13 l) Sensor spots and small amounts of rubbish can be removed from the image, but permanent objects cannot be removed or altered;
(13 m) Stitching multiple images is permitted, with a maximum angle of view of 180 degrees, but only if all images were captured at the same time and of the same subject, and they must be                          submitted as one digital file;
(13 n) Use of multiple images for HDR is not permitted;
(13 o) The use of graduated filters, polarising filters, colour correction filters and neutral density filters is permitted;
( 13 p) For images captured on film, You may use two images of the same scene, captured at the same time, to compensate for lack of dynamic range on film.
(14) Entries submitted will be vetted by the Promoter and may, in the Promoter’s absolute discretion, be displayed on the Competition Website. For the sake of clarity, display of an entry on                      the Website will not be an indication of preliminary scoring or of winning entries. The Promoter reserves the right, at its sole discretion, to disqualify and/or remove any entry that does                      not comply with Competition guidelines, even after the entry is submitted on the Website and/or displayed on the Website.
(15) You agree that You are fully responsible for each entry You submit. The Promoter shall not be liable in any way for any entries to the full extent permitted by law.
(16) You warrant and agree that:
(16 a) You are the sole owner and author of each entry;
(16 b) You have the right to submit your entry to the Competition ;
(16 c) Your entry does not contain any content that is unlawful, infringing, fraudulent, defamatory, obscene, abusive, inflammatory, libellous, vulgar, derogatory, pornographic, sexually                                 inappropriate, violent, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for                                       publication;
(16 d) Your entry is not in breach of any intellectual property, privacy, publicity or other rights of any person;
(16 e) You have obtained consent from any person who’s likeness or property appears in your entry;
(16 f) You have obtained full consent from any person who has jointly created the entry, or has any rights in the entry, to the uses and terms herein;
(16 g) Your entry shall not contain viruses or cause injury or harm to any person or entity;
(16 h) You fully indemnify the Promoter in respect of all royalties, fees and any other monies owing to any person by reason of You breaching any of the foregoing;
(16 i) Your entry may be used by the Promoter and its Event partners, without compensation, in print and digital form and/or as part of an exhibition, for the purposes of promoting and                              marketing the Competition now and in the future; and
(16 k) You will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’                    computer or communication systems.
(17) Without limiting any other terms herein, You agree to indemnify the Promoter for any breach of the terms stated in the above clause 17.
(18) Any costs associated with accessing the Website are your responsibility and are dependent on your internet service provider.
(19) The Promoter acknowledges that You will retain full ownership of the copyright in each entry You submit.
(20) You must upload each entry as a digital file via the Website according to the following specifications:
(20 a) sRGB colour space, 8-bit;
(20 b) Measure 2000 pixels on the longest side;
(20 c) Image to be saved as a JPEG at a setting of 8 (80%) or higher.
(20 d) Rename each image using the format “First name_last name_image number.jpg”. Judges will not see these file names.
(21) Major prize winners and entrants eligible for Gold or Silver Certificates may be asked to provide a high resolution digital file (RAW if possible).
(22) During judging, no names or other indicators will be shown to the judges that could identify the author of the entry.
(23) The judging process will be as follows:
(23 a) Judges will have no access to any personal information about Competition entrants, nor to the original file names, so their decisions cannot be influenced or compromised by their                               relationships.
(23 b) All entries will be subjected to Preliminary Judging and given a score out of 100 points (“Preliminary Score”).
(23 c) Each entry with a Preliminary Score over 50 points, will proceed to Final Judging (“Final Judging”).
(23 d) Each entry which proceeds to Final Judging will be judged independently by each of the three Competition Judges in accordance with the judging criteria set out in Clause 13.
(23 e) During Final Judging, each entry will receive a score out of 100 by each of the Competition Judges. Scores from the 3 judges will then be averaged to determine the Final Scores for each                  entry and the three winning entries.
(23 f) In the event that 2 entries each receive the same Final Score, the judges will be asked to make a decision as to which entry will be awarded first place.
(23 g) Each entry with a Final Score between 80 and 90 points will be awarded a Silver Certificate.
(23 h) Each entry with a Final Score over 90 points will be awarded a Gold Certificate.
(23 i) The Judges’ decision will be final and no correspondence will be entered into.
(23 j) Winning entrants will be notified by email within two (2) weeks of the end of the Competition and their images will be exhibited in the Winners Gallery of the Competition Website at                          www.realphotoawards.com.
(23 k) Recipients of Gold and Silver Certificates may also have their images exhibited on the Competition Website.
(23 l) If the Promoter cannot contact a winning entrant by email within a reasonable time, the judges may award the prize/s to another entrant.

(25) There are no alternative prizes available for winners. Prizes are not transferrable or exchangeable and cannot be taken as cash, unless otherwise specified.
(26) All decisions of the Promoter are final and no correspondence will be entered into.
(27) The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entry that is not in accordance with these Terms and Conditions, or any entrant who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at this stage does not constitute a waiver of those rights.
(28) Winning entrants must agree to participate in related publicity and agree to the use of their name and likeness without compensation for the purposes of advertising and promoting the Competition in 2016 and in future years.
(29) You agree that each entry submitted to the Competition may be used by the Promoter and its Event Partners, without compensation, for the purposes of marketing and promoting the Competition in 2016 and in future years, including the production of a book (printed or digital) about the Competition.
(30) If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
(30 a) disqualify any entrant; or
(30 b) to modify, suspend, terminate or cancel the Competition as appropriate.
(31) Entry fees are quoted in Australian dollars.
(32) Entries are subject to the laws of Australia and the state of New South Wales.
(33) The Promoter assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilised in the Competition, and the Promoter assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the Competition.
(34) The Promoter assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries to the Competition.
(35) Terms and Conditions are subject to change without notice, with the exception of copyright clauses.

PRIVACY POLICY:
The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Event Partners and prize suppliers. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter.
